Terms and Conditions

By completing the application process, Claimants confirm their acceptance of these terms and conditions.
1. Eligibility
1.1 To be eligible to claim the AUD$50 cashback ("Cashback"), eligible claimants ("Claimants") must purchase a new Creative Vado Pocket Video Cam ("Product") from the Creative e-store during the period 30th July 2008 and 6th September 2008 ("Promotional Period") or while stocks last. This offer for cash back cannot be used in conjunction with any other Creative promotions.
1.2 Only one (1) Cashback claim per qualifying purchase and Claimant will be accepted. The application form is available from Creative e-store. Applications must be received by Creative no later than midnight EST, 12th September 2008. Claims received after this date will be deemed invalid and ineligible to receive the Cashback.
1.3 Creative's decision on all matters pertaining to this Cashback promotion is final and binding and no correspondence will be entered into, except as otherwise stated in these terms and conditions. No correspondence will be entered into after 9 weeks of the closing date of this Cashback promotion.
2. Making a Claim
2.1 Claimants must obtain and fully complete the official Claim Form, attach the original barcodes from the Products as well as photocopies of their original receipt(s) verifying their purchase of a Creatuve Vado Pocket Video Cam, during the Promotional Period. Claim Forms which are not fully complete and/or which are not attached with the original barcode and/or receipt shall be deemed to be invalid.
2.2 Only photocopies of original receipt(s) verifying date of purchase, product type purchased and indication of full or final payment of Products within the Promotional Period will be accepted. Hand written receipt(s), delivery docket(s) or Lay-by deposit/part payment receipt(s) will not be accepted.
2.3 Only original barcodes cut out from the eligible Creative Product boxes will be accepted. Photocopies of barcodes will not be accepted.
2.4 Claims are to be sent to "Creative Vado $50 Cashback Promotion", PO Box 7514, Silverwater, NSW 2128. This postal address is for submittal of applications relating to this offer only; all other correspondences will be refused.
2.4 Claims must arrive no later than 12th September 2008 or they will be invalid.
3. Issuance of Cashback
3.1 Once claims have been received and verified by Creative, the Cashback will be issued to the person or organisation as named on the Claim Form within 90 days of receipt of Claim Form and required documents. Cashback is not transferable or assignable.
3.2 All Cashbacks will be paid by cheque to the person and address as stated on the Claim Form. It is the responsibility of the Claimant to provide correct details in the Claim Form. Delays and non-payment of claims that arise as a result of supplying incorrect details are the responsibility of the Claimant. The Claimant accepts this as a condition of this promotion.
3.3 Liability for any tax as a result of the Cashback being provided to a Claimant pursuant to this Promotion shall be the sole responsibility of the Claimant.
4. Liability for Loss/Damage
4.1 Creative shall have the right:
  • to verify the validity of all claims and to disqualify any Claimant for submitting a claim which is not in accordance with these Terms and Conditions, or for tampering with the claim process. Claims will be deemed invalid if the same receipt number or receipt is used for more than one claim;
  • to extend the closing date of the promotion at its discretion;
  • to refuse any claims if the Products are returned. Claims will not be accepted on back-ordered Products;
  • to alter, amend, or foreclose this promotion without prior notice; and
  • where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid claims including, without limitation, to require further verification as to the identity, age, and other relevant details of an entrant or claimant and/or the verification as to their qualifying purchase before sending to the Claimant the Cashback.
5. Liability for Loss/Damage
5.1 Creative, its affiliates, directors, officers and employees shall not be liable for and accepts no responsibility for:
  • any loss or damage whatsoever which is suffered (including, without limitation, indirect or consequential loss), or for a personal injury suffered or sustained, as a result of participation in this promotion, except for any liability which cannot be excluded by law;
  • any technical, hardware, software, server, website, or other, failures or damage of any kind;
  • misdirected, delayed or lost mail, incomplete or illegible applications or damaged mail. Applications by fax, telephone or email will not be accepted. Proof of posting / dispatch will not be accepted as proof of receipt; and
  • any interruption to this Cashback promotion whether due to force majeure or other factors beyond the Creative's control.
6. Personal Information
6.1 All Claim Forms and documents submitted therewith become and remain the property of Creative upon receipt. All Claim Application Documents (including proof of purchase) will not be returned.

7. Governing Law
7.1 These Terms and Conditions shall be governed by and construed in accordance with the laws in force in New South Wales, Australia.
